Trump’s DOJ Sues to Block Alaska From Certifying Its Senate Race If Republican Dan Sullivan Loses
Donald Trump’s Justice Department filed a lawsuit Thursday asking a federal judge to block Alaska from certifying its U.S. Senate race if Republican Sen. Dan Sullivan loses.
WASHINGTON, DC – Donald Trump’s Justice Department filed a lawsuit Thursday asking a federal judge to block Alaska from certifying its U.S. Senate race if Republican Sen. Dan Sullivan loses, just 10 days before Election Day. The suit targets a second candidate on the ballot, Dan J. Sullivan of Petersburg, and asks the court to freeze the results if the senator loses by fewer votes than the other Sullivan receives. The filing came hours after Attorney General Todd Blanche refused to rule out DOJ trying to block states from certifying midterm results. He knew his department was about to do exactly that.
Alaska’s courts already settled this. A state judge ruled in June that election officials had invented a “good faith” test for candidates that appears nowhere in the law, and the Alaska Supreme Court ordered the Petersburg Sullivan onto the ballot. Ranked choice voting also lets any voter who mixes them up rank both. Notre Dame law professor Derek Muller told the AP the suit lacks legal merit because federal law gives DOJ no power to block certification.
“Trump’s DOJ just showed the country its plan for any election Republicans lose: sue to throw out the results,” said Mally Smith, Try And Stop Us Senior Adviser. “Alaska’s courts already ruled on this candidate, Alaska’s Republican officials got their say on designing the ballot, and Alaskans are already voting. None of that matters to an administration that wants a federal judge on standby to cancel an election it doesn’t like. Trump tried this in 2020 and lost. This lawsuit is every bit as baseless, and Alaska voters will decide this race no matter what Trump’s goons say.”
